§ 70-117. Required rules for reduction of wastewater demand

  • (a) The town shall require the implementation of the following rules to effect a 20 percent reduction of wastewater demand:

    (1) No tank type water closet shall be installed with water usage in excess of 3½ gallons upon each flush.

    (2) No shower head or faucet shall be installed which allows a flow of more than an average of three gallons per minute at 60 pounds of pressure per square inch.

    (b) Use of treated wastewater for irrigation of median strips and rights-of-way shall be encouraged.

    (c) The town shall require in its land development review process that proposed development be permitted for wastewater treatment capacity at a level no greater than the number of residential or commercial units proposed for construction within a one-year period. The one-year period shall begin after the award of a building permit by the town. Any subsequent expansion of a development project shall require new permitting for wastewater by the state department of environmental protection in accordance with this article. Development projects that have not used allocated capacity within two years after start of construction shall be required to relinquish any excess capacity reserved in that project's name.
